Bookings and Cancellations
i. To make an online reservation for bicycle hire, you will be required to enter your credit or debit card details at the point of booking, to secure the booking.
ii. If you need to cancel your reservation, you should contact us by email on evolutionbikeslanzarote@gmail.com
i. If you inform us of said cancellation with at least one weeks notice prior to the collection date, no rental fee will be charged.
ii. If the cancellation request is received within one week of the rental start, 50% of the rental fee will be charged to your credit or debit card.
iii. If the cancellation request is received with less than 24 hours notice, we will charge your debit/credit card for the full payment of the reservation.
iv. If you are going to be delayed by half a day or more (4+ hours from pre arranged reservation time) please keep us informed. Otherwise, we will cancel your reservation the morning after your starting date and your credit/debit card will be charged for the full rental amount.
v. No cancellations will be accepted due to weather conditions.
Costs
You shall pay the amount indicated in the rental contract. This sum shall be paid in full when the bicycle(s) and equipment are received by you, the client. You are also obliged to pay any extension to the rental period upon extending the rental.
Documents required
When we deliver your bicycle(s) and other equipment, you should present a valid and currently effective identity document. You can present your passport, national identity card, foreign residency permit, or driving licence (photocard only, paper driving licences without a photo will not be accepted). A credit/debit card shall not be accepted as a valid ID document. We will also keep record of your contact details whilst staying in Lanzarote: name of hotel/apartment
complex & room number, or address of your villa/holiday home rental, along with a mobile contact number.
Evolution Bikes reserves the right to take a security deposit upon renting bicycles & equipment, made on a credit card or in cash, which will cover any possible damage to the bicycle or the rented equipment. This deposit shall be returned to you, the client, upon the termination of the contract.
In the event of an accident, damage, loss or theft of the bicycle, the client shall immediately notify Evolution Bikes and shall subsequently lose all rights to request the reimbursement of the deposit, as well as reimbursement or compensation for the unused rental days remaining on the rental contract.
Evolution Bikes offers optional bike damage insurance cover at an additional cost to the bicycle hire cost. This is not included in the bicycle hire cost and you have the option to take the insurance out at the time of booking your bike, or upon delivery of your bike. This does not include cover against theft of the bicycle or equipment in whole, or in part, nor does it cover personal injury. In the event of an accident or mishap, the excess payable by you, the client, will be equal to the value of 20% of the costs to repair the damages to the bike or bike components and/or any replacement parts required. The other 80% of those costs will be covered by the insurance. In the event of accidental damage without taking out insurance, you will be liable to pay 100% of the cost of replacing or repairing the damage incurred to the bicycle or equipment.
Rental period
You the client, are solely responsible for the bicycle(s) and other equipment during the rental period. The rental period commences when we deliver your bicycle/equipment to you, and ends when a member of the Evolution Bikes staff receives it back from you. Evolution Bikes shall provide you with the bicycle/s and other equipment (helmets, pedals etc) in perfect working condition. You should return all bicycles/equipment in the same condition as they were when they were received, apart from habitual wear and tear (on tyres, brakes, etc.). Any reclamations regarding the state of the bicycle or equipment must be made before accepting the rented bicycle/s. You as the client shall adopt all measures required to avoid the theft, loss, misplacement or damage to the bicycle and equipment. In the event of any of the aforementioned circumstances happening during the rental period, regardless of the party at fault, you as the client understand and agree to be fully responsible and will have to immediately cover the full cost of replacement of the bicycle/s, equipment and/or parts at retail price. When you sign this rental contract, you authorise Evolution Bikes to charge your payment card for all costs incurred during the rental period.
When the bicycle(s) and other equipment are returned, the staff of Evolution Bikes shall check them to confirm their condition. If there are any breakages or damage found not to be caused by general wear and tear, you are obliged to pay the recommended retail price plus labour fee to replace or repair each damaged part.
• Bicycles & rental equipment shall be delivered directly to you at the start of your hire period, and collected from you at the end of your hire period. Returned bikes must be handed to a member of the Evolution Bikes staff. Bicycles and gear should never be left unattended outside your accommodation for collection by us.
• If the bicycles and equipment are returned before the end of the contracted period, you shall not be reimbursed any of the rental fee for the remaining time period.
• Extension of the bicycle rental agreement must be requested before the end of the existing contract, by way of email, Whats App, or telephone call, and must be agreed by Evolution Bikes prior to the end time/date of the original rental period, for you to be able to keep the bike for the extended period. Refusal of an extension can be made by Evolution Bikes in the event of no availability. However, every effort will be made to accommodate the client’s request, where possible.
• If you breach the contracted period without prior agreement with Evolution Bikes, you will be obliged to pay a late fee or forfeit your rental deposit, to the equivalent sum of double the daily rental fee. In the case that you return the bike later than agreed, and this has an impact on another customer’s reservation, we will impose a penalty up to the full value of the loss of said reservation.
Use of the bicycles(s) and equipment
Evolution Bikes advises the wearing of helmets at all times when riding a bike. According to Spanish law Children under 16 are required to use the helmet at all times, whenever they ride a bicycle or are a passenger, for example in a bike seat. For cyclists over the age of 16, the use of a helmet is mandatory outside of urban areas.
Although all our bikes are professionally serviced before each rental, bicycles may need tuning or maintenance during the rental period; such maintenance will be carried out at Evolution Bikes expense taking place solely by mechanics from Evolution Bikes.
The installation of accessories or items on the rented bicycle will only be authorised when such items are installed and uninstalled by Evolution Bikes own mechanics.
We will cover the cost of damages due to equipment failures beyond you, the client’s control; i.e. worn parts. You must stop using the bicycle(s) as soon as you detect a problem. Any deficiencies must be communicated to Evolution Bikes immediately. Individual bike specifications are subject to change based on availability of replacement components. Instruction in the use, assembly and maintenance of bicycles will not be provided and you, as the client affirm that you are competent and familiar with the use of a multi-speed bicycle.
The rented bicycle may only be used by the client named in the rental contract, unless Evolution Bikes has been otherwise notified of its use by third parties, who will be duly identified in the rental contract. You, the client will be responsible for any actions carried out by the third parties, and shall inform them of the conditions of the contract. The client may not sublease the bicycle or a part thereof, including any tools and items provided with it to any third parties.
Likewise, the bicycles may not be taken off the island without prior authorisation from Evolution Bikes, nor used for amateur or professional races without prior agreement with Evolution Bikes.
Evolution Bikes cannot be held responsible for the following occurrences during bike rental: gear tune ups / punctures / broken spokes / broken chains / broken derailleurs / broken drop-outs / wheel rim damage / torn saddles / damage beyond the control of Evolution Bikes and resultant of rider use or misuse. It is you, the clients responsibility to: Ride the bicycle(s) with due care and skill, riding with respect and care for others is essential. Operate the rental bike in a manner appropriate to prevailing road and weather conditions. Use the bicycle(s) in accordance with Spanish law, always respecting the road and traffic regulations. Know the relevant rules of the road and practice safe cycling. Wear a helmet and other protective clothing. You are obliged to use said measures whenever you are using the bicycle(s). Evolution Bikes recommends that you pass the bike lock through the frame, saddle, and wheels, and attach the lock to a fixed object or parking site designed for parking bicycles. In any case, the lock is only a deterrent measure, so bicycles that are unattended will be left at the clients own risk, and any thefts incurred shall be paid for in full by the client. As the client, you are responsible for being insured, with an appropriate cover against risks that could be produced during the rental period. Any loss or damage to the bike must be reported to Evolution Bikes immediately. Evolution Bikes shall not be held liable under any circumstances for any accidents, injuries or deaths, or for any damage or injury caused to third parties. Evolution Bikes shall not be held liable for the loss of any personal items or for the theft of same that might take place during the rental period.
You hereby declare that you are in perfect health and that you know how to use the bicycle(s) and other rented material.
You must declare to be over the age of 18 years to enter into this contract and to have full physical and mental capabilities, as well as being perfectly healthy, having sufficient knowledge and experience to use the bicycle & equipment. You declare that you are aware that this activity is carried out at your own risk. Evolution Bikes will not be liable for any accidents, material or personal damage that you, the client, may suffer as the result of this activity. If you are under
the age of 18, you must be accompanied by a parent/legal guardian who should sign the contract on your behalf and accept the liability clause. The client shall assume liability for any and all damage or loss of and to personal property, accident / injury to other persons related to said rental equipment. Evolution Bikes cannot provide a personal accident insurance. We strongly recommend that you always carry a personal or travel insurance policy.
Accidents, theft and damage
You should immediately inform both Evolution Bikes & make a formal report with the Police, at the earliest opportunity, if you have been involved in an accident, or the rental bicycle has been stolen in whole or part. It is your responsibility to complete any documentation for police/insurance purposes.
If you lose the bicycle/s and/or the other equipment, or if it is stolen, you are obliged to pay the total price of the bicycle/s or equipment at their RRP. if it is damaged and you have opted not to take out or optional bike damage insurance, you are obliged to pay the total price of the bicycle/s or equipment at their RRP. If it is damaged and you have taken out our damage cover, you will be obliged to pay 20% of the costs to repair/replace the damaged parts, and the other 80% will be covered by our insurance.
TERMINATION OF AGREEMENT
You, the client, agree that Evolution Bikes has the right to terminate this agreement at any time and retake possession of said bicycle(s), equipment. The information provided by you, the client will be exclusively used for the correct rendering of the service/s purchased. In accordance with Spanish Organic Law 3/2018, of 5 December, on the Protection of Personal Data and guarantee of digital rights, the client has the right of access, amendment, cancellation and opposition, by notifying Evolution Bikes through any means of communication.
You, the client hereby state to have read, listened, understood and asked any possible questions, with regard to the specific use of the rented equipment, and the basic safety, behaviour and environmental advice provided by the organisation upon delivery of the rented equipment.
This contract is governed by the Laws of Spain, and you, the client hereby accept its bases and conditions. Any conflicts that may arise during the enforcement of this contract will be subjected to the Courts of Arrecife & the language used in the arbitral proceedings shall be Spanish.
